Chairman Capener called the Planning Commission Meeting to order at 5:30 p.m. The meeting was held January 28, 2020 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Chairman Capener, Commission Members Eberhard, Sorensen, Stokes, City Councilmember Rohde, Zoning Administrator Bench, and Deputy Recorder Nelson were in attendance.

1. Approval of agenda:

Motion by Commission Member Eberhard to approve the January 28, 2020 agenda. Motion seconded by Commission Member Stokes. Vote: Chairman Capener – aye, Commission Member Eberhard – aye, Commission Member Sorensen – aye, Commission Member Stokes – aye. Motion approved.

2. Approval of minutes—no minutes to approve at this time.

Chairman Capener called a Public Hearing to order at 5:31 p.m. to receive public input on a zone change. There were five people in attendance.

3. Public Hearing:

a. To receive public input on a proposed zone change of property located at 60 South 480 West. The proposal would change the zoning from Commercial District (CD) to Residential Multi Family (RM-16)

Resident Stacey Liechty asked how big of a unit is being proposed. Chairman Capener said the developer is just proposing a rezone from commercial to multi-family.

Developer Gary Madsen said it is currently zoned commercial and is at the back of the motel and my office building on Main Street before going into residential. Most of the neighbors would probably prefer something residential opposed to a strip mall or more commercial across the street from their homes. I think it is a nice buffer or transition from the commercial district to the residential. It makes sense to put that there. It has been left vacant for a long time and it will look a lot nicer when I am done.

Chairman Capener closed the Public Hearing at 5:33 p.m.   

4. New Business:

a. Discussion and consideration of a proposed zone change of property located at 60 South 480 West. The proposal would change the zoning from Commercial District (CD) to Residential Multi Family (RM-16)

Commission Member Stokes said I have an opinion on what I call island zoning. He asked about the different zoning and buffers for the area. Do you have a proposed layout of what it would look like? Mr. Madsen said I would put a minimum of two buildings with four units in each (on .82 acres). They will be nice units with garages that come off the back of the unit with the parking lot behind. The one car garage will face the hotel and the frontage will be on 480 West. They would be townhome style so they could be sold individually. We need more affordable housing in this community and that is what I am trying to do. They will have a design and be landscaped. I am working on acquiring an easement along 100 South, along the fence line, to add a road over that. If that easement comes through, he would have enough space for two four-plexes and a duplex. Commission Member Stokes said so we have to go to RM-16 to get it in there? Chairman Capener said to fit two four-plexes you would. Mr. Madsen said we are looking to do the eight units for sure, but might be up to 10 if we do the duplex. Chairman Capener said this is the center of town and it needs to be our most dense whether it is commercial or multi-family. Commission Member Eberhard said I like the idea—that has been a sore spot. Councilmember Rohde said the neighbors might appreciate a complex like that more than a commercial building. Chairman Capener said we could extend the mixed-use from across the street. However, the mixed-use zone does not delineate specific unit density. It is just on a site plan approval basis by the DRC. Administrator Bench said maybe that could be extended, but that would be a lot of work to get the same result.

Motion by Commission Member Eberhard to change this to RM-16 and recommend it to the City Council. Motion seconded by Commission Member Sorensen. Vote: Chairman Capener – aye, Commission Member Eberhard – aye, Commission Member Sorensen – aye, Commission Member Stokes – nay. Motion approved by a 3-1 vote.

b. Discussion and consideration of Preliminary Review for Tremont Place Subdivision, Phase 2

Chairman Capener declared a conflict of interest and abstained from the vote. He addressed the dead end that was questioned last time and said I do not want to pay for the extra road so it would be a cul-de-sac. The Commission agreed that would be better. Administrator Bench said this is just north of the ball diamond and would have a temporary turn around going north for Phase 3. That phase will go up above here and connect to Tremont Street again. It will connect to the subdivision to the south, but not the north.

Motion by Commission Member Stokes to approve and send it back to the DRC. Motion seconded by Commission Member Eberhard. Vote: Commission Member Eberhard – aye, Commission Member Sorensen – aye, Commission Member Stokes – aye. Motion approved. Chairman Capener – abstained.

5. Adjournment

Motion by Commission Member Stokes to adjourn the meeting. Motion seconded by consensus of the Board. The meeting adjourned at 5:53 p.m.
