Chairman Bench called the Land Use Authority Board Meeting to order at 9:07 a.m. The meeting was held March 14, 2018 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Chairman Steve Bench, Engineer Chris Breinholt, Director Paul Fulgham, and Deputy Recorder Cynthia Nelson were in attendance. Manager Warnke and Director Christensen were excused.

1. Approval of agenda:

Motion by Director Fulgham to approve the March 14, 2018 agenda. Motion seconded by Administrator Bench. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye. Motion approved.

2. Approval of minutes: February 14 & 28, 2018

Motion by Director Fulgham to approve the minutes of February 14 & 28, 2018. Motion seconded by Administrator Bench. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye. Motion approved.

3. New Business:

a. Final Approval for Garfield Subdivision, Phase 3 – Gary Madsen

Engineer Breinholt asked Mr. Madsen if he was going to build some before he records. Administrator Bench said they can work that out through the development agreement, but they need a cost to build before they record. They wanted to make sure the Ag Protection was on there, which it is. Engineer Breinholt said do we need to schedule a pre-construction meeting and who is going to do the work. Director Fulgham said it is ready for final approval. They might change the landscaping on the ponds—doing all rock instead of rock with sod on the sides. Mr. Madsen said we might still do that, but Director Fulgham had mentioned he would not mind rock on all of it because of the water situation. I talked to Clayton Grover who thinks he can find big rock for about the same price. What would you prefer? Director Fulgham said it is sixes to me. If we go secondary then I will most likely pull the rock out so it becomes more of a neighborhood green, open space. As soon as you finish and turn it over to us we will mow it. If you do rock, add the weed barrier and then I would just spray it. Do whatever you would rather, I’ll just make a motion that we approve it with landscaping changes coming back to me for approval. Mr. Grover would still stub water into the meters. Mr. Madsen said I thought if we went with the rock we would save those two water connections. Director Fulgham said if he does do rock I can forgo it because I will not sod it until we get secondary water over there. We could do a surface well—we will just have to bring power to it. He told Mr. Madsen to make sure he gets the right size of rock. Administrator Bench told Mr. Madsen to get the engineer’s estimate to Engineer Breinholt. Mr. Madsen said do you want the estimate before or after that pre-construction meeting. Engineer Breinholt said it does not matter. I would like to have it sooner rather than later. You have to submit the cost for the whole thing because that is what the guarantee is based on even though when you get to the point of recording you are only escrowing for what is left plus the 10%. Mr. Madsen said he plans to record closer to May. Director Fulgham said to have Mr. Grover get with them on the pre-construction and send over the estimate. Administrator Bench talked about the development agreement and said they would need the front money for streetlights ($1,500 per light) and chip seal, which is a set dollar amount based on square feet. Engineer Breinholt said this was submitted before the requirement to install secondary water lines. Director Fulgham said it has to go to the City Council for approval to have the City install the lines before the road is put in. They would save the road by installing now, but it is in service area 9 and 10, which will be a few years down the road. They will talk to the City Council about it.

Motion by Director Fulgham to approve the final for Garfield Subdivision Phase 3, with any changes in landscaping to come to Director Fulgham for approval. Motion seconded by Engineer Breinholt. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye. Motion approved.

b. Walk ins:*

Developer Lyle Holmgren was in attendance. Administrator Bench said the trouble is we have not seen anything. Mr. Holmgren said he would give them what he has and asked to be put on the agenda in two weeks. He said the information was sent yesterday for phase 7. Engineer Breinholt told Director Fulgham they need to work out the drainage for this whole area. It needs to come through and the best place is this road here. This line will need to be upsized on the City’s dime. Mr. Holmgren asked if they have the drainage master plan, which they do. They talked about the different size of pipes based on the plan. Director Fulgham went over the minutes and said we gave approval for phase 6 previously, but it does not get recorded until you are satisfied. Mr. Holmgren said we jumped over here so we can pull it together. We might have to come down and do those two phases as one. Administrator Bench said half of 8 or all of 8? Mr. Holmgren said all of 8, then 6 is not too bad, but it does have that intersection. The pipe and everything is partly done. Administrator Bench said Manager Warnke had a preference. We are working on the right one because he wanted to get that park setting finished off. Mr. Holmgren said this one will finish that off and open up those lots to the river. Engineer Breinholt said we will have to oversize these for the storm drain from what you need and it will be detained flow. It will not be too much more. Mr. Holmgren said what do you want in addition to what I have here? Director Fulgham said you need to start working on final type stuff. By then we will know what size we need to upsize that pipe to and we will participate with you in that. Mr. Holmgren asked about the detention areas. Engineer Breinholt said we might have to talk about extending that one at the bottom of the hill. It has changed a bit, but they will plan for the two basins. He will go back and review it. Mr. Holmgren asked if they could go right to final. Administrator Bench said if you are ready we would do preliminary/final. Engineer Breinholt said to get him the plans this week. Mr. Holmgren asked Engineer Breinholt to correspond with Mike if he sees any problems so they can plan for the final on March 28.

Mr. Holmgren then brought up secondary water and the bacteria report since he and Director Fulgham are meeting with the canal company. Director Fulgham said it shows pass or not pass because that is all we record it as, but I can do an MPN. We were looking to see if it had fecal in there or not. The MPN will tell us the most probable number, meaning what kind of concentration or count of bacteria E.coli is in the water. This is a test from the canal water. He then talked about the different findings and what that tells them. We did have some E.coli and fecal bacteria. I could have done an MPN test like we do at the treatment plant. He then explained that process. He also showed the sampling sites they took from. He will give the canal company the data and will show them their monthly average count in their wastewater. We have a daily and a monthly. Daily we can have up to 156 colonies, but our monthly average has to be 127 or below. Last month our geometric mean for that was .6, meaning there were virtually no colonies. Last year we exceeded our permit for several months in a row because we had so much water going through the system and we could not get a good kill. We were required to take the chlorine out because it is harmful for the fish. Engineer Breinholt said so you can show pretty definitively that that wastewater is cleaner than the canal water already. Director Fulgham said he could even go to the wastewater drop site and take weekly samples to have them run with their tests. Wastewater is listed as a field sample and any lab can do it. Mr. Holmgren asked if it smells like sewer going into the Malad River. Director Fulgham said it does not.

The Board said they would need the construction contract and development agreement before they can record Mr. Holmgren’s plat. Engineer Breinholt said he has what he needs for right now, but suggested pushing Mike ahead to do the final. Mr. Holmgren said he would and that some of that work is already done. On phase 6 we will see what a year brings us. If we have to we will start over again.

The Board then discussed other projects that are in the works, including the RV Park and Tremonton Pines. They have no update from Adam for the RV Park. They also wondered what the hold up is on the bridge in Tremonton Pines. Director Fulgham said they cannot add buildings until they get their bridge in. Administrator Bench said you cannot get a true estimate until they figure out who is going to record. Director Fulgham said all we need is estimates on the public side of things. We do not need money for the sewer and water because that is all private. They talked about the fencing, which will separate the subdivision from the canal and railroad tracks. Director Fulgham said the only thing that is public is that intersection—the street itself is private. They will have to show they are hooking to a secondary system before any landscaping is done. Engineer Breinholt said Mr. Chadaz is not required to put in secondary lines with this phase because it was all prior to the Council’s emergency ordinance to put that in. Director Fulgham said they would have to take that to the City Council to make a decision for when to install those lines for Chadaz B. This one butts up to the basin in phase 3 and is about 10 feet from the pump.
