Chairman Bench called the Land Use Authority Board Meeting to order at 9:09 a.m. The meeting was held January 11, 2017 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Chairman Steve Bench, Engineer Chris Breinholt, Director Paul Fulgham, City Manager Shawn Warnke, and Deputy Recorder Cynthia Nelson were in attendance.

1. Approval of agenda:

Motion by Director Fulgham to approve the January 11, 2017 agenda. Chairman Bench noted item 3 b. was removed from the agenda. Motion seconded by Manager Warnke. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, Manager Warnke – aye. Motion approved.

2. Approval of minutes: December 21, 2017

Motion by Director Fulgham to approve the minutes of December 21, 2016. Motion seconded by Engineer Breinholt. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, Manager Warnke – aye. Motion approved.

3. New Business:

a. Discussion and consideration of Preliminary Approval for Sorensen Subdivision, Phase 3 – Chris Sorensen

Jim Christensen talked about the notes from the Board. They discussed the need for a sewer main to be stubbed and a pressurized irrigation lateral. There is a line in the road but not in lateral. They talked about 450 North and the need for an easement. The sewer will need to be extended for lots 8 and 9. It must have at least a right-of-way or manhole.

They noted the pricing they were quoted for roads. Box Elder School District has budgeted a little less than $1M for roads around the school. A third of the students will be bussed. Faculty, staff, parent parking, and bus drop off will be off the road. They will coordinate with utility connections. There is usually a small period of congestion at the end of school.

Chris Sorensen will farm the area around the school until another phase of the subdivision. Mr. Sorensen’s taxes will go up once the lots are improved.

There was talk that the fire hydrant location may need to be moved. The telecommunication conduit is labeled as cable. They are usually in the easement. There was talk about a road dedication or having a clean joint. Mr. Christensen stated they will get a letter from the Canal Company noting the volume of flow that must be maintained. It is not reasonable to contact every water user. It is a personal ditch once it leaves the canal. Mr. Sorensen burns the ditch once a year. In the future, the users must maintain and take care of any issues not the land owners. There may need to be a manhole for access. There will be a headwall or gate.

The samples have been taken for the soils report. They discussed an easement to temporary pond. The School District will maintain water until the size and location is determined for a permanent pond. The Board discussed easements and property owners. Engineer Breinholt noted the master plan calls for a 36” (thirty-six inch) pipe. The City would pay the difference for the upsizing. The size will be determined at a later date as the grade and other things are known.

Manager Warnke wondered if there can be precautions taken in case of flooding in case of a blockage. Homeowners would need to be told not to plant trees in the back so roots would not damage the ditch. There could be a berm to help handle backup from flooding or blockage.

Engineer Breinholt will note the lines are not up to standard and have things shifted. The items will be fixed on the construction drawings. The irrigation ditches were addressed. The pipe will be shown on plan with financial guarantee but will not need to go in if not necessary in the future. The Board noted there will be a pond on the north.

Motion by Director Fulgham to approve the preliminary drawings with those notes that we made for the Sorensen Subdivision. Motion seconded by Manager Warnke. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, and Manager Warnke – aye. Motion approved.

b. Discussion and consideration of Final Approval for Chadaz Estates, Phase 3A – Mark Smith and Sattar Tabriz

This item was canceled.

c. Review of Annexation Petition and Road Alignment – Val Stokes and Jim Flint

Chairman Bench noted there was some opposition to Mr. Stokes proposed business at the Planning Commission last night. Mr. Stokes addressed each item.

d. Walk ins*

There were no walk ins.

Director Fulgham noted the flags are showing and Engineer Breinholt can review them. Engineer Breinholt noted they can get a Warranty Deed and dedicate it on the road plat. Manager Warnke noted there should be a Development Agreement with the annexation that lists the improvements. Engineer Breinholt talked to Steve Ball. Mr. Ball needs numbers for justification. Director Fulgham will get the traffic counts. Manager Warnke stated the need to get an amended application turned in.
