Chairman Bench called the Land Use Authority Board Meeting to order at 9:04 a.m. The meeting was held November 1, 2017 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Chairman Steve Bench, Engineer Chris Breinholt, Director Paul Fulgham, City Manager Shawn Warnke, and Deputy Recorder Cynthia Nelson were in attendance. Director Christensen was excused.

1. Approval of agenda:

Motion by Director Fulgham to approve the November 1, 2017 agenda. Motion seconded by Manager Warnke. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, Manager Warnke – aye. Motion approved.

2. Approval of minutes: October 25, 2017

Director Fulgham who was not in attendance during last week’s meeting questioned if Mr. Madsen made comments on the Stokes Property. They said he did have a few questions about what was going on, but Director Fulgham suggested the Board look at the minutes further before making an approval. The minutes tabled.

3. New Business:

a. Preliminary review for River Valley 4-Plex Subdivision Phase 2 Lot 22 & 23 Amendment – Sierra Homes Brian Lyon

Brian Lyon said I am here for questions, but I think it is real straightforward. Administrator Bench asked if there were any changes made from the last time. Mr. Lyon said he has not touched it.

Manager Warnke asked about cross access easements and wondered if there were any cross access for utilities and for dumpsters. Mr. Lyon said they would put the dumpsters in the back and could show an easement going back there. For an access he thinks they could use the same area, but will clean it up. Manager Warnke said they might need it to be more specific since the access and dumpsters are different. Mr. Lyon said he put a note on there showing it is access for utilities, but will make sure there are no questions. Manager Warnke confirmed the direction they are planning to go with the access utility. Mr. Lyon said it would probably come off of 2650 West. Engineer Breinholt asked if something is stubbed in. Mr. Lyon said my guess is it would be stubbed in for each. We are taking one lateral and making two, but I do not have the construction plans. Director Fulgham said some of those were stubbed in with a two-inch meter, while some were three quarters, but they went back in and changed things for a single meter, but I do not know what is in there. Mr. Lyon showed where the meters would go. Director Fulgham said we like them on our street, if not then you are responsible for everything except for the meter in the future. Mr. Lyon said I guess we could put them here in the park strip, is that what you like? Director Fulgham said yes. Mr. Lyon asked if they had copies or “as built” drawings. That way we can at least let the contractor know what needs to be done. Engineer Breinholt said they have the construction plans. Director Fulgham said Jay Stocking should have the construction drawings. Mr. Lyon said it is called River Route 4-plex Subdivision Phase 2. Engineer Breinholt said he would see what he has.

Manager Warnke asked how the storm water works and wondered if that needed to be contemplated. Mr. Lyon said no because the storm water will stay on the lot. Manager Warnke asked if it would drain to a cross gutter. Engineer Breinholt said it will drain to the street, but will just be covered in the easement with the utility. He asked Mr. Lyon if he makes them put another service in the road rather than teeing off of one that is behind the curb. Mr. Lyon said yes. Director Fulgham added that when there is a problem he ends up shutting down two complexes instead of one if it is not done that way. Manager Warnke added that it could also be sold.

Manager Warnke asked if there were any other public infrastructure that is needed. He said it is not really public, but would it come into the City’s right of way? Mr. Lyon said storm and water. Director Fulgham said that is part of their permit fee—nothing special.

Administrator Bench asked if there was anything else to discuss. This is just preliminary and will go to Planning Commission on November 14. Manager Warnke asked about Matt Nelson and what he does (he attended last week’s meeting as a representative for Sierra Homes). Mr. Lyon said he does their land development in this area (Box Elder and Cache counties). He runs the development and is good at his job.

Mr. Lyon asked more about the preliminary and final processes, which Administrator Bench explained.

Manager Warnke told Mr. Lyon they were going to talk to Mr. Nelson about upgrading the finishes on the exterior so they are more long lasting. He said that is the hope for the City. He asked Mr. Lyon if he would pass that information onto Mr. Nelson. Mr. Lyon said that is not his call, but would talk to Mr. Nelson about it. He wondered what the City was wanting. Manager Warnke said something more that can last and not deteriorate as quickly.
Engineer Breinholt said this is preliminary and in this case we do not do construction drawings, we usually do preliminary as the construction to show those services. He asked if this is on an agricultural protection area. Manager Warnke said he would check.

Motion by Engineer Breinholt to approve it, but said they need to add water and sewer services on construction to the preliminary plat. Motion seconded by Director Fulgham. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, and Manager Warnke – aye. Motion approved.

6. Adjournment:

Motion by Director Fulgham to adjourn the meeting. Motion seconded by consensus of the Board. The meeting adjourned at 9:20 a.m.
